1. INTRODUCTION

Welcome to Safe Tune Music (“Safe Tune Music,” “we,” “us,” or “our”).

Safe Tune Music provides digital music distribution and related services to independent artists, record labels, producers, and authorized content owners. Our services may include music and video delivery, release management, royalty reporting, monetization, rights administration, and artist support.

These Terms & Conditions (“Terms”) govern your access to and use of our website, user dashboard, distribution platform, and related services.

By creating an account, accessing our platform, or submitting content for distribution, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the services.

If you use Safe Tune Music on behalf of a record label, company, or another individual, you confirm that you are authorized to accept these Terms on their behalf.

2. ELIGIBILITY AND USER ACCOUNTS

To use our services, you must:

  • Provide accurate, complete, and up-to-date registration information.

  • Have the legal capacity to enter into a binding agreement.

  • Be authorized to distribute the content submitted through your account.

  • Keep your login credentials confidential and protect your account from unauthorized access.

  • Notify us promptly if you suspect account misuse, unauthorized access, or fraudulent activity.

You are responsible for activity conducted through your account, subject to applicable law.

We may request identity verification, proof of ownership, business documentation, tax information, or other relevant records when reasonably necessary to provide our services, comply with legal obligations, or investigate suspected fraud.

We reserve the right to reject or restrict account applications where permitted by law and for legitimate operational, compliance, or security reasons.

3. SERVICES PROVIDED BY SAFE TUNE MUSIC

Safe Tune Music may provide services including:

  • Digital music distribution to supported streaming platforms and online stores.

  • Music and video release management.

  • Artist and label account management.

  • Royalty reporting and payout processing.

  • Eligible content identification, monetization, and rights management services.

  • Assistance with artist profiles and Official Artist Channel (OAC) requests.

  • Metadata corrections, release updates, takedown requests, and copyright-related support.

The availability of individual services depends on your account, applicable agreements, platform eligibility, technical requirements, and third-party policies.

We do not guarantee that every release will be accepted by every DSP or that every requested rights management or monetization service will be approved.

4. CONTENT OWNERSHIP AND DISTRIBUTION AUTHORIZATION

You retain ownership of your music and other intellectual property, except for rights you separately transfer under a written agreement.

By submitting content to Safe Tune Music, you represent and warrant that:

  1. You own or control the rights necessary to distribute the content, or you have obtained valid authorization from the relevant rights holders.

  2. You have the necessary permissions for all relevant audio recordings, musical compositions, lyrics, samples, performances, artwork, photographs, videos, and other included material.

  3. Your content does not knowingly infringe copyright, trademark, privacy, publicity, or other third-party rights.

  4. Your metadata, ownership information, artist credits, and release details are accurate and not misleading.

  5. Any samples, remixes, covers, interpolations, or third-party materials have the licenses or permissions required for the intended use.

You must not submit stolen, unauthorized, fraudulent, misleading, or unlawfully obtained content.

Distribution License

For the purpose of providing the services you request, you grant Safe Tune Music a non-exclusive, worldwide license, for the duration of the applicable distribution agreement, to:

  • Deliver, reproduce, transmit, and make your authorized content available to selected DSPs and distribution partners.

  • Convert or technically format files as necessary for delivery.

  • Display relevant artist names, approved artwork, release metadata, and promotional materials.

  • Process and administer releases, takedowns, royalty reporting, and related rights management activities.

  • Authorize relevant service providers and distribution partners to perform the actions necessary to deliver the services.

This license is limited to the purposes described above and does not transfer ownership of your content to Safe Tune Music.

Any additional exclusivity, publishing administration, Content ID, or rights management arrangement must be covered by the applicable service terms or a separate written agreement.

5. ARTIST AND CONTENT RESPONSIBILITIES

You are responsible for the legality, accuracy, and authorization of the content submitted through your account.

You must not upload or distribute content that:

  • Infringes another person’s intellectual property rights.

  • Contains unlawful threats, exploitation, or prohibited material.

  • Promotes illegal activity in violation of applicable law or platform policies.

  • Contains fraudulent streams, artificial engagement, manipulated metadata, or misleading ownership claims.

  • Impersonates another artist or misrepresents the identity of a rights holder.

  • Violates the terms or content policies of relevant DSPs.

You must also comply with applicable laws and the reasonable technical and content requirements of the platforms receiving your releases.

If a release contains incorrect metadata, disputed ownership, or unauthorized material, you must cooperate with reasonable requests to correct or resolve the issue.

6. ROYALTIES, EARNINGS, AND PAYMENTS

6.1 Royalty Reporting

Where supported by our distribution arrangements, royalties and earnings reported by DSPs will be credited or reflected in your Safe Tune Music account according to the applicable reporting and accounting procedures.

Royalty amounts may depend on platform reports, territory, usage, applicable deductions, taxes, exchange rates, distribution agreements, and other relevant factors.

Reports may be delayed, revised, adjusted, or corrected when updated information is received from DSPs or payment partners.

6.2 Payment Eligibility

Payments are subject to:

  • Your applicable distribution agreement and account plan.

  • Any published minimum payout threshold.

  • Supported payment methods and geographic availability.

  • Successful identity and payment verification, where required.

  • The availability and clearance of payable funds.

  • Applicable taxes, legal requirements, and legitimate adjustments.

Available payment methods, processing times, and payout thresholds will be communicated through the relevant account settings, service terms, or distribution agreement.

6.3 Payout Requests

You may request a payout through the available dashboard features, where supported.

A payout request does not guarantee immediate payment. Processing time may depend on verification, payment provider procedures, banking schedules, compliance checks, and other circumstances outside our reasonable control.

6.4 Disputed Royalties and Adjustments

If a DSP reverses, withholds, or adjusts reported earnings, or if a credible dispute arises concerning ownership or entitlement, we may make corresponding adjustments to the relevant account in accordance with the applicable agreements and law.

Where reasonably possible, we will provide an explanation for material adjustments.

We may temporarily delay a disputed payment when reasonably necessary to investigate suspected fraud, resolve an ownership dispute, or comply with a legal requirement. Any withholding must be handled in accordance with the applicable agreement and law.

6.5 Taxes and Payment Details

You are responsible for providing accurate payment details and for fulfilling your own tax obligations, except where applicable law requires us or a payment provider to withhold, report, or remit amounts.

You must promptly update your payment information if it changes.

7. FEES, SUBSCRIPTIONS, AND REFUNDS

Any distribution fees, subscription charges, commissions, or other service charges will be disclosed through the relevant plan, pricing page, checkout, or written agreement.

You are responsible for reviewing applicable charges before purchasing a service.

Refund eligibility, cancellation rights, and treatment of unused services will be governed by the applicable service agreement, published refund policy, and mandatory consumer protection laws.

Nothing in these Terms excludes a refund or other remedy that cannot lawfully be excluded.

8. CONTENT ID AND RIGHTS MANAGEMENT

Safe Tune Music may offer eligible content identification, monetization, or rights management services through supported third-party systems.

Eligibility and approval may depend on ownership requirements, exclusivity restrictions, platform policies, and the nature of the submitted content.

You must not submit content for rights management if you lack the necessary rights or authority.

You must promptly notify us if ownership changes, a license expires, or a dispute arises that could affect a release or rights management registration.

We do not guarantee that every release will qualify for YouTube Content ID, Meta Rights Manager, TikTok-related services, or any other third-party rights management program.

9. COPYRIGHT CLAIMS AND DISPUTES

If Safe Tune Music receives a credible copyright complaint, rights dispute, takedown notice, or other legal claim concerning your content, we may investigate and take reasonable action.

Depending on the circumstances, this may include:

  • Requesting proof of ownership or distribution authorization.

  • Temporarily restricting a release or related service.

  • Forwarding relevant information to a DSP or authorized rights holder.

  • Requesting corrections, licenses, or other supporting documents.

  • Removing or requesting removal of disputed content where appropriate.

  • Suspending relevant monetization or payments when permitted by law and the applicable agreement.

You agree to cooperate reasonably with legitimate investigations concerning your content.

Nothing in this section prevents you from exercising any legal rights or submitting a lawful response to a claim.

10. ACCOUNT SUSPENSION AND TERMINATION

You may request account closure or termination in accordance with the procedures and conditions of your distribution agreement.

Safe Tune Music may suspend, restrict, or terminate access to all or part of the services where reasonably necessary if:

  • You materially breach these Terms or an applicable distribution agreement.

  • You submit unauthorized, fraudulent, or infringing content.

  • You provide materially false information or fail required verification.

  • Your account is associated with artificial streaming, payment fraud, or other prohibited conduct.

  • Continued service would violate applicable law, a binding legal order, or a relevant platform requirement.

  • Suspension is reasonably necessary to protect users, rights holders, or platform security.

Where reasonably practicable and legally permitted, we will provide notice and an opportunity to address the issue. Immediate action may be necessary to prevent harm, respond to a legal requirement, or protect against suspected fraud.

Termination does not automatically eliminate payment obligations, accrued rights, outstanding disputes, or provisions intended to survive termination.

Following termination, content removal from DSPs will be handled in accordance with the relevant distribution agreement and applicable platform procedures.

11. CONTENT REMOVAL AND TAKEDOWN REQUESTS

You may request removal of your content by using the available dashboard features or contacting our support team.

We will process valid requests in accordance with the applicable agreement and relevant DSP procedures.

A takedown may take time to complete because each DSP controls its own processing timelines. We cannot guarantee immediate removal from every platform, cache, user library, or third-party service.

We may also remove or restrict content when reasonably necessary to address credible rights disputes, material policy violations, legal requirements, or security risks.

Where appropriate, we may notify you of a takedown or restriction and provide relevant information about the reason.

12. THIRD-PARTY PLATFORMS AND SERVICES

Our services depend in part on third-party DSPs, payment providers, hosting services, and other external systems.

Each third party may have its own terms, eligibility criteria, technical requirements, and content policies.

Safe Tune Music does not control the independent operations of these third parties and cannot guarantee uninterrupted availability, acceptance of releases, specific placement, playlist inclusion, streaming numbers, revenue levels, or continued availability of a particular service.

We will make reasonable efforts to administer our services, but third-party decisions and outages may affect delivery, reporting, monetization, and payments.

13. INTELLECTUAL PROPERTY OF SAFE TUNE MUSIC

Unless otherwise stated, the Safe Tune Music name, logo, website design, dashboard interface, original text, and other platform materials are owned by or licensed to Safe Tune Music.

You may not reproduce, distribute, modify, reverse engineer, or commercially exploit our protected materials without permission, except where permitted by applicable law.

Nothing in these Terms gives Safe Tune Music ownership of your music or gives you ownership of our platform intellectual property.

14. PRIVACY AND DATA PROTECTION

We collect and process personal information as described in our Privacy Policy:

https://safetunemusic.com/privacy-policy

Our handling of personal information is subject to applicable data protection and privacy laws.

By using our services, you acknowledge that information may be processed as necessary to provide the services, administer your account, deliver releases, process payments, protect rights, and meet legal obligations.

Where separate consent is required by law, we will seek it as applicable.

15. SERVICE AVAILABILITY AND MODIFICATIONS

We may update, improve, suspend, or discontinue features of our services when reasonably necessary for operational, technical, security, legal, or business reasons.

Where practicable, we will provide notice of material changes that significantly affect users.

We do not guarantee that the website, dashboard, or every feature will always be available without interruption or error.

Nothing in this section removes obligations under an applicable distribution agreement or mandatory law.

16. DISCLAIMERS

To the extent permitted by applicable law, our services are provided subject to these Terms and the relevant service agreement.

We do not guarantee:

  • Acceptance of every release by every DSP.

  • A specific number of streams, downloads, followers, or listeners.

  • Playlist placement, editorial promotion, or commercial success.

  • Approval for every monetization or rights management program.

  • That third-party services will remain available without interruption.

  • That all third-party reports or estimates will be final when first received.

We will perform our contractual obligations in accordance with the applicable agreement and law.

Nothing in these Terms excludes a guarantee, duty, or liability that cannot legally be excluded.

17. LIMITATION OF LIABILITY

To the extent permitted by applicable law, Safe Tune Music will not be liable for indirect, incidental, special, or consequential losses arising from your use of the services, including loss of anticipated profits, opportunities, or business, where such exclusion is legally permitted.

Our liability for a particular service will be determined under the applicable agreement and governing law.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or any other liability that cannot lawfully be excluded or limited.

18. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Safe Tune Music and its personnel harmless from third-party claims, losses, liabilities, and reasonable costs arising directly from:

  • Your material breach of these Terms.

  • Your unauthorized submission or distribution of content.

  • Your infringement of third-party rights.

  • Your fraudulent conduct or material misrepresentation.

This provision applies only to the extent the relevant claim results from your conduct or breach. It does not require you to indemnify Safe Tune Music for losses caused by our own unlawful conduct or liabilities that cannot legally be transferred to you.

We will handle any applicable claim in accordance with the law and may request reasonable cooperation from you.

19. CHANGES TO THESE TERMS

We may revise these Terms from time to time to reflect changes in our services, agreements, business operations, or legal requirements.

The latest version will be published on our website with an updated effective date.

Where a change materially affects your rights or obligations, we will provide notice where reasonably practicable and where required by law.

Your continued use of the services after revised Terms take effect constitutes acceptance only to the extent recognized by applicable law. Where explicit consent is required, we will request it.

20. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are subject to the mandatory laws applicable to the relevant Safe Tune Music contracting entity and transaction.

The governing law and competent courts or dispute resolution procedures should be identified in the applicable distribution agreement or other binding contract, taking account of the contracting entity, the user’s location, and mandatory legal requirements.

Nothing in these Terms is intended to exclude mandatory consumer protections or other legal rights that apply to you.

If a dispute arises, the parties are encouraged to attempt to resolve it through good-faith communication before pursuing formal legal proceedings, unless urgent legal action is necessary.

21. GENERAL PROVISIONS

Entire Agreement: These Terms, together with the applicable distribution agreement, Privacy Policy, and any relevant service-specific terms, form the agreement governing your use of the services. If provisions conflict, the applicable order of precedence will be determined by the relevant agreements and applicable law.

Severability: If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

No Waiver: Failure to enforce a provision does not automatically waive the right to enforce it later.

Assignment: You may not transfer your account or contractual rights where doing so is prohibited by the applicable agreement. Safe Tune Music may transfer its rights or obligations only as permitted by the applicable agreement and law.

Electronic Communications: To the extent permitted by law, notices and agreements may be provided electronically through your registered email address, dashboard, or website.
